Are you concerned about the new Endorsements and Testimonials guidance? Are you completely sure you are ready to comply? The changes are extensive – for the first time since 1980 many of the industry’s earlier safe harbor practices are no longer protected.

You will no longer be able to use phrases like “results not typical” as a safe harbor. Instead, the advertisement will be evaluated holistically, so complying may be a challenge. The FTC has also made it clear that blogs and social media websites will be examined closely and may in some cases have standards that differ from their print counterparts.
